Organizational Setup

In Punjab a full-fledged Directorate General of Katchi Abadis & Urban Improvement is working under the Local Government and Rural Development Department Government of the Punjab. All policy matters are being looked after by the Directorate General in liasion with the Katchi Abadis Cell of Ministry of Environment, Local Government & Rural Development, Government of Pakistan. At the lower levels the Development Authorities are performing the functions of Executing Agencies and are responsible for implementing the Katchi Abadis Regularization/Development Programme in big cities like Lahore, Faisalabad, Multan, Rawalpindi, etc. As such the Faisalabad Development Authority is working as Executing Agency on behalf of Directorate General Katchi Abadis & Urban Improvement, Punjab, for implementing the policy decisions of the Federal/Provincial Government.

    Functions

  1. To implement the regularization programme in the recognized Katchi Abadies within the jurisdiction of Faisalabad Development Authority as per policies framed by DG KA&UI Punjab.
  2. To carry out site verification/ re-verification of record/ facts of enlisted/declared Katchi Abadies under the direction of the D.G., KA&UI, Punjab.
  3. To process/scrutinize the cases for issuance of demand notices to the eligible dwellers and to recover the cost of land and development charges at the prescribed rates.
  4. To process the cases for grant of proprietary rights to the eligible dwellers of duly notified/declared/ transferred Katchi Abadies.
  5. To process and initiate cases for the approval of Implementation Committee (IC).
  6. To arrange holding of the IC meeting.

Issuance of Demand Notices

Demand notices are issued to the eligible dwellers in duly notified / declared/transferred Katchi Abadis on provisional basis on the criteria that name of the dweller should exist in the survey list, and dweller should furnish proof of continuous occupation/residence in a particular dwelling unit of a transferred Katchi Abadi prior to cut-off date of 23rd March, 1985. The dweller should also provide an affidavit on the prescribed stamped paper of Rs: 20/- duly verified/attested by a Magistrate Ist Class or a Notary Public. An application alongwith requisite documents and copy of National Identity Card may be submitted at the public counter or presented in person by the bonafide dweller in the Katchi Abadis Cell located at Main Building of FDA, Civil Lines, Faisalabad.

Schedule of Recoveries

As per prevailing policy of the Government, the cost of land and development charges are to be collected/ recovered before grant of proprietary rights to the eligible dwellers in duly notified/declared Katchi Abadis land which has been transferred/mutated in favour of Faisalabad Development Authority.

    Cost of Land

    The cost of land is recoverable/chargeable at the following rates: -
  1. For pure residential dwelling unit having area not exceeding 5 Marla, the payment of cost of land is to be made @ Rs: 172/= per Marla.
  2. For pure residential dwelling unit having area exceeding 5 marla, for every extra marla the residential market rate of 1985 duly approved by the then District Implementation Committee is to be made.
  3. For partially commercial and partially residential dwelling unit having area not exceeding 5 Marla, cost of land is to be made @ Rs: 172/= per Marla.
  4. For partially commercial and partially residential dwelling unit having area exceeding 5 Marla, the commercial market rate of 1985 for every extra Marla duly approved by the then District Implementation Committee is to be charged.

Development Charges

The Development charges are recoverable/chargeable at the rate of Rs. 1000/- per Marla in addition to the cost of land from the eligible dwellers. Presently the government has reduced the rate of development charges by 50% i.e. the per marla rate is Rs: 500/=. The present concession is eligible upto 31st March 2003.

Grant Of Proprietary Rights

Proprietary rights are to be granted to the eligible dwellers of those notified / declared Katchi Abadies land which has been transferred /mutated in favour of the Faisalabad Development Authority. The case for grant of proprietary rights to the bonafide dweller is finalized after recovery/realization of charges/dues regarding cost of land and development charges.

Policy Regarding New Occupants

The prevailing policy of the Government is that the proprietary rights should be granted to such occupants who have constructed dwelling units before the cut off date of 23rd March, 1985. The same policy is also applicable to the present occupant of the surveyed dwelling units after due verification, provided the present occupant has purchased the plot/malba from the original survey holder. The approval of the DIC is mandatory in this case. Same rates are levied on the original dwellers as well as present occupant.

Substitution of Legal Heirs

As per standing policy of FDA, in case any dweller dies, the legal heirs of the deceased dweller are required to submit his/her case to the City Tehsildar for verification/finalisation of legal heirs. The Tehsildar City, after due verification at site and publication of the advertisement in the local and national newspaper, finalise and forward the “Shajra Nasb” to the Authority for further necessary action.

For substitution of legal heirs in place of original dweller, a hand-written application along with the original copy of “Shajra Nasb” prepared by the Tehsildar City, copies of National Identity Cards duly attested by a Gazetted Officer / notary public may be presented to the office. Decision on such applications are taken by the District Implementation Committee.

District Implementation Committee (DIC)

Vide notification dated 19.10.2002 from the Directorate General of Katchi Abadies and Urban Improvement, partial modification of already issued notification dated 14.12.2001 was made and Implementation Committee for Faisalabad was reconstituted. The members of the IC are as follows:

    Mandate Of The District Implementation Committee (DIC)

  1. To assist the government and the Director General, Katchi abadies, in the performance of their functions.
  2. To be responsible for effective coordination of the activities of the Directorate General pertaining to Katchi Abadies with those of the concerned agencies in the respective areas.
  3. To ensure prevention of encroachments in Katchi abadies.
  4. To take such steps as may be necessary or conducive to the attainment of the objectives of Punjab Katchi Abadies Act, 1992.
  5. To monitor the progress of Development works in Katchi abadies.
  6. To decide all matters regarding inclusion of left over names of any person in possession of state land in any enlisted / recognized Katchi abadies on which he has constructed a dwelling unit before 23rd March 1985, correction of survey lists including of mis-spelled names, incorrect enteries of parentage, identity card Nos. and measurement of area under occupation of dwellers.
  7. To perform such other functions as may be assigned to it by the government.
  8. To ensure recovery of government dues.
  9. To furnish periodical reports to the government/Directorate General Katchi Abadies.
